一方面，从意思要素看，公法行为的基础是法律，即行政行为是行政机关依据法定职权和法定程序作出的(根据我国当前的行政行为理论通说，行政行为也须具有一定的意思表示，但这种意思必须是法效意思，是为了达到行政法律效果的意思)，并且法律优位原则是行政法的基本原则之一，不允许采取与法律规定不同的行为。中国政法大学副校长马怀德在会上表示，报告对2016年我国法治政府建设的发展进行了总体梳理和客观描述，包括法治政府建设实践和法治政府理论两大方面，其中重点关注了新《行政诉讼法》实施周年回顾、现代城市交通法治状况与未来展望、共享经济的法律规制、行政公益诉讼、政府信息公开的理论与实践发展等内容。代驾行业乱象法律规制研究--以重庆代驾行业为例。
